Minutes:

The Licensing Officer introduced the report. The hearing related to an application for a premises license under the Licensing Act 2003 made by WyldsFarm, Warren Road, Liss, Hampshire, GU33 7DF.

 

A copy of the application was in Appendix A and a copy of the plans of the premises were shown in Appendix B of the agenda.

 

The application had received a number of representations from interested persons shown in Appendix C.

 

All responsible authorities had been consulted.

Environmental Protection responded with no objections.

 

Hampshire Fire and Rescue Service responded with no objections.

Planning authorities responded with no objections.

 

No further comments were received from the remaining responsible authorities.

 

The committee were advised that in determining this application they may:

·       Grant the application as asked

·       Modify the conditions of the licence, by altering, omitting or adding to them

·       Refuse to specify a person in the licence as the premises supervisor

·       Reject the whole or part of the application.

 

The Chairman invited the interested parties to state their case, each interested party was advised they would have 2minutes.

The interested parties expressed concerns to the Sub-Committee about the levels of noise and traffic that could be created if the application was to be granted alongside the environmental impact on surrounding wildlife.
 

The Legal representative clarified to members of the Licensing Sub-Committee and interested parties present the licensing objectives to consider.


The Chairman invited the applicants witness to state their case.

 

The witness made her statement of support in the applicant to the Sub-Committee.

 

The Chairman invited the applicant to state their case.

 

The applicant addressed the Sub-Committee.

Members asked questions of the applicant.

 

The Chairman invited the Licensing Officer to make a closing statement.

 

The Licensing Officer addressed the Sub-Committee, reminding it that having considered everything presented, the Sub-Committee was obliged to determine this application with a view to promoting the licensing objectives:

 

Prevention of crime and disorder

Public safety

Prevention of Public nuisance

Protection of children from harm

In making deliberations it must have regard to the Councils Licensing Policy and National Guidance.

 

The Sub-Committee must have regard to the representations that had been made, balanced by any conditions offered by the applicant and the evidence that had been heard.

 

The Sub-Committee must take one of the following steps, as it considered necessary for the promotion of the licensing objectives. They may:

 

Grant the application as asked

Modify the conditions of the licence by altering, omitting or adding to them

Refuse to specify a person as the premises supervisor

Reject whole or part of the application

The Sub-Committee should note that it cannot modify the conditions or reject the whole or part of the application merely because it considers it desirable to do so. It must be appropriate in order to promote the licensing objectives.

 

The Chairman invited the applicant to sum up their case.
