The Head of Legal Services introduced the report. The purpose of the report was to review the Local Government Association (LGA) Draft Model Code of Conduct that went out to consultation from 8 June 2020 to 15 August 2020. To consider the model code against the proposed draft code at Appendix 2 which had been produced in response to the Standards Committee Working Group.

 

He went through the draft code recommendation by recommendation; many had been included in the proposed draft code and many were also in place.

 

Following a discussion and vote:

 

1.     The report of the LGA Draft Model Code was NOTED and it was AGREED that the Monitoring Officer was to respond to the report on behalf of the Committee.

 

2.     It was RECOMMENDED to the Constitution Sub-Committee and Full Council the adoption of the Code of Conduct as set out in Appendix 2;

 

3.     AGREED to delegate to the Monitoring Officer authority to make minor inconsequential amendments to the Code of Conduct prior to approval at Full Council.

The Committee will consider a report on Councillor Code of Conduct complaints received since January 2020. 

 

The appendix to the report is exempt, therefore the committee will be invited to consider passing a resolution to enter exempt session (agenda item 7) if it wishes to discuss the details contained within it.

Councillor Johnson proposed that this item be held in exempt session. The proposal was seconded by Councillor Boxall.

 

The committee voted on the proposal 6 Councillors voting for the Proposal, no Councillors voting against and no councillors abstaining.

 

Following the vote the Committee went into exempt session.

19.

Exclusion of the Press and Public

RECOMMENDED that the press and public be excluded as:

 

a) It is likely, in view of the nature of the business to be transacted, or the nature of the proceedings, that if member of the public were present during the item there would be disclosure to them of exempt information as specified in Part 1 of Schedule 12A (as amended) to the Local Government Act 1972; and 

 

b) In all the circumstances of the case, the public interest in maintaining the exemption outweighs the public interest in disclosing the information.
