The Chairman invited the Licensing Team Leader to introduce their report.

 

 

This hearing relates to an application for a premises licence for Rother Barn Christmas Tree Farm, Farnham Road, Liss, Hampshire, GU33 6LJ. The application has been made by Rother Projects 2017 Limited. 

 

A copy of the application is in Appendix A, from page 9 of the agenda. The plan of the premises is shown in Appendix B, page 37 and 38, and the location plan is shown in Appendix C, page 39 of the agenda. 

 

The applicant describes the premises as a moveable container bar situated within the premises which is primarily a Christmas tree farm.  They have requested a premises licence for the provision of live music outdoors and the supply of alcohol on the premises. The application asks the applicant to state how they will promote the licensing objectives, and this is shown in section 3.5, page 2, of your agenda.

 

This hearing is being called because representations have been received from Environmental Protection, a responsible authority as shown in Appendix D, page 41 and also from interested persons as shown in Appendix E, from page 45 of the agenda. 

 

All responsible authorities have been consulted.

 

Environmental Protection made a representation to the application as they have concerns that granting the licence would pose significant risk of public nuisance from noise. They have requested that should a licence be granted, six conditions be considered to reduce the risk of public nuisance by an acceptable amount. These six conditions are detailed in section 3.7, from page 3 of the agenda and also in Appendix D. I understand Environmental Protection has discussed some or all of these conditions with the applicant, but Licensing has not received anything from the applicant in response to this.

 

Hampshire Fire Service responded with no objections.

 

Planning responded but their response was not relevant to the licensing objectives, but they advised that the applicant seek pre-planning advice.

 

No further comments were received from the remaining responsible authorities.

 

Over 60 representations have been received in total with one supporting the application and the rest opposing the application. The representations relate to the prevention of public nuisance, protecting children from harm, public safety and the prevention of crime and disorder.    

 

 

The committee are advised that in determining this application

 

  • they may grant the application as asked
  • modify the conditions of the licence, by altering, omitting or adding
  • refuse to specify a person as the premises supervisor
  • reject the whole or part of the application
