Taxi and Private Hire Licensing Policy

Minutes:

The Licensing Team Leader introduced the report and outlined all of the major changes proposed in detail.

 

The committee agreed to the following amendments to the Hackney Carriage and Private Hire Policies and Conditions (additional wording added in italics and deleted wording is struck through):

 

·                     Page 100, the ninth paragraph to read ‘Where a licence holder accumulates more than 12 or more penalty points in any 36 month period, the matter…’

·                     Page 101, Offence/Breach of Condition 6 to read ‘Using unlicensed vehicle or vehicle without insurance or valid MOT.’

·                     Page 101, Offence/Breach of Condition 10 to read ‘Failure to produce evidence of a MOT certificate when requested.’

·                     Page 101, Offence/Breach of Condition 12 to read ‘Failure to provide proof evidence of insurance cover when requested.’

·                     Page 103, Offence/Breach of Condition 41 to read ‘Unsatisfactory appearance of the driver Failure to comply with the Council’s policy in relation to the appearance of the driver.’

·                     Page 103, Offence/Breach of Condition 53 to read ‘Failure to carry approved spare wheel and tools Failure to observe the authority’s policy on spare wheels.’

·                     Page 103, Offence/Breach of Condition 58 to read ‘Waiting or stopping on a double yellow line area, bus stop or private land (without the owner’s permission) in a restricted area unless requested by a paying customer present in the vehicle.’

 

Following the vote, the recommendation was declared CARRIED, 11 Councillors voting FOR the recommendation, no Councillors voting AGAINST the recommendation and no Councillors ABSTAINING from voting.

 

Therefore, following the discussion, it was RESOLVED:

 

·                     That the Hackney Carriage and Private Hire Policies and Conditions enclosed in the Appendices to the report as amended are adopted; and

·                     That the Service Manager (Environmental Health) in consultation with the Chairman of the Licensing Committee be authorised to make minor amendments to the Policy as may be required from time to time.
